  • Westgate PH Towers Problems

    So, has anyone had issues with the Westgate PH Towers Sale to Hilton Vacations? I couldn't afford the astronomical price of the mortgage, so back in June 2011, Westgate sent me a letter stating if I fill in a Warranty Deed in Lieu of Foreclosure, they would take the property back and I would owe nothing.

    Now, 10 months later, Hilton is sending me a bill stating I owe them maintenance fees for 2011 and I'm past due. Now, Westgate is telling me that I am still an owner and that the WDIL never was posted with the county because the sale from PH to Hilton went through so the WDIL had the wrong name on it as the "owner" and rejected it.

    Now, Westgate sent me a 1099 for $31K as a "debt forgiveness" for 2011, and they claim that it was not supposed to be sent and was cancelled, yet when my CPA called the IRS, the IRS stated that Westgate never rescinded the 1099.

    Now, Westgate wants me to sign an LPOA but on that LPOA it states that I am acknowledging that I am still an owner and still financially responsible for this.

    Are there any other owners getting screwed like this? I'm seriously thinking of a class-action against Westgate and David Seigal.

    So sorry to hear of this mess but it comes as no surprise whatsoever to anyone that has ever had to deal with the Wastegate group.

    As for advice all I can say is do whatever you have to to get rid of it. No great insight beyond that. Every so often someone comes along asking why we (and I) are SO anti-Wastegate. After all they have a nice week / resort at Orlando or Branson or Park City and all seems well. The easy answer is there are only two types of Wastegate owners. Those who are disillusioned, disgusted, dejected and looking to sue the convicted criminals that own/operate the mess and those who haven't been screwed over yet but will be joining group one at some point in the probably near future. You are getting your taste now, sorry to say.

      It would be nice to be able to see the Warranty Deed in Lieu of Foreclosure letter you got. I own there, bought resale. It's hard to believe that Westgate would offer to take the deed back.

        Wastegate is Wastegate.

        I would never put anything passed them.

          The deed does not have to be recorded to be effective. If they accepted it, which it sounds like they did, you should have an enforceable deal. maybe you should have a lawyer write them a letter.
