trying to get title to UDI

Welcome to my world! I had a similar issue with a purchase I made. Problem is unless the MF's are paid, BG will not complete the transfer. I would suspect the MF's were actually due in November, however that of course can depend on the type. Still have yet to receive my 10,000 points purchased back in September.
Consider yourself now in the proverbial "rock and a hard place" as they already have your $475 for the closing costs. They will say they have done their end but that the buyer/seller is not completing theirs, therefore due diligence on the closing companies part has been completed.

no the maintenance fees on UDI's come out now and are due either June 1 or july 1. He was paid up for the year til that date.
We purchased a lot from someone who had purchased from bluegreen back in 2001. He hadn't paid taxes or maintenace fees. went through a closing company and they withheld all the necessary back fees and mailed them to bluegreen. At this time, some office worker decided that the person we bought the lot from didn't own it. this was not the case. She just decided to put the checks in a drawer and not process it.
come June and we have no maintenance fee bill, we have paid taxes, lot is in our name since previous august. title company and supervisors had to get involved to get them to change our name in their records. I didn't expect much for this transaction but the seller kept saying they told him it would take two to three weeks. Not impressed at all

And don't forget the special assessment just levied - UDI owners have to pay for three intervals - Steve Chapin has posted about it here.

right now just speculation.
I just remodeled my home at Christmas mountain. costs are nowhere near what they are saying. the question is whether it is one interval or three intervals. remember, one bathroom, a small kitchen they don't even have closets. how could they need $1300 times 51 to remodel something that is just over 600 square feet.

Pat, you are right it is all speculation and IMHO I think it is all based on a Bluegreen "Red Herring" to test the waters.

Bruce (cz) knows how to do UDI closings quickly, efficiently, and cheaply. I suggest you get with him over the phone and become pro-active in the closing process and perhaps give up on your $475 you have in the hopper. Since the maintenance fees which are due June 1 have now been billed, those will have to be paid before the transfer to you can take place, even though they are not actually due until June 1.
The special assessments have not even been determined so they have not been billed so those are not yet due. If they had been billed, then those would be due. And let's say that those were able to be paid over three years......you would still have to pay the whole thing before you would be able to close. I know this from selling back to BG our Shenandoah Crossings UDI. We were in the midst of a three year special assessment and had paid one year of it. Even though we were selling it back to BG, we still had to pay the two other years of special assessments before we could close on our deal. (Of course, this was all done on paper, but still we had to pay it.)
So the big thing is, you will want to close on this deal before the special assessments are billed so that you don't have to end up paying the entire special assessment bill up front--that it will be able to be paid over the three years on a payment plan if that's what you so desire. This is big and anyone who is considering purchase a UDI should pay close attention to this. I think I may post this on the BG Yahoo group too.

Give the address of Christmas Mountain (Take from deed)
SKIP section on Township, range etc.
For name of condo give Timbers at Christmas Mountain
Type legal description from deed. Make sure to include Week # and Unit #
For property type, choose Condo and for use choose time share
SKIP the questions on Lot size and acreage
Under Conveyance, choose Warranty Deed
SKIP all weatherization questions
Do fees with amount agreed upon for the time share with no exemptions
Type in your own name and address for Prepare

Send in the receipt, the check, and a newly prepared Warranty Deed between Grantee and Grantor
Blank form available under Sauk County website. Click on Government and drop down to Register of Deeds. At bottom of page are Links. Choose Forms and documents and choose Warranty Deed (from Chicago Title Company)

Note, to do the deed yourself. We make several copies of the old deed and we just use the old deed and for the “The Grantor” and “Grantee” white out the old names and paste in the new names and white out the old notary names and witness so the same form can be used again. Then we make 4 copies and sign all 4 and have all of the 4 copies notarized. Then we send all but one to the other party to have them sign 3 and have them have their signatures notarized and have the new owners send one back to us. Then you will send one copy to Sauk County to complete the transfer of ownership.
Then the new owner after getting New Warranty Deed back then makes 3 copies and sends one copy and a check for $100 (deeded) or $125 or $250 it keeps changing so call (for Points) payable to the “Bluegreen Corporation”
And mail to the Bluegreen Asset Recovery Department, 4960 Conference Way, Boca Raton, Florida, 33431

the person who sold me the UDI has 5 spacebanked weeks with RCi that he would like to sell. Two are expiring in Sept the other two go through 2012. It sounds like they are only 12 to 14 TPUS. I believse the RCI transfer fee would be $98, plus what you pay him and then the $99 to combine or extend. I have his info if anyone is interested.
