    Villa del Palmar, Puerto Vallarta

These guys told us we'd get $25,000 for our timeshare. They subtracted that figure from the $29,500 fee for a master suite with 4 extra weeks, it was some kind of preferred plan. We expected to pay just a $4,500 figure to change from our time share to Villa. Guess What? When it all came down we were billed the full amount with the understanding that the Gerrard guy would handle the anticipated sale of our time share. Contacted him and paid the $700 plus and were assured that it would be sold in a couple of weeks. Well, 4/1/2 months later, no sale of our time share and I'm making monthly payments on the $29,500 bill - $21,000 to Villa and $7800 to BOA. We got snookered good. I am trying to decide just how I will handle the non sale, the promises, the BOA note et al. I talked with BOA and they said if I contest the charge arranged by Villa they would hold payments in abeyance till the dispute is settled. I'lm trying to figure out what legal rights I might have in trying to decide my next course of action. I'm sorry to say I fell for the bait and switch with promised sales schmooze they did on me. Anyone out there with any ideas?

i'll definitely keep you ALL updated as to what happens!
Story is familiar: my father just retuned from PV and bought a week with a $8,000.00 down payment and a $30,000 note and paid an additional $785 fee to get a "check" for 5 weeks in December from Villa del Palmas Flamingo. The "con" is on! The misrepresentations and out right lies from Jeff Moore & Steven Gerard are repeated in many posts and clearly are contradicted in the contract.
Does anyone have any solution on stopping the contract and need I dare say recover the monies?
The credit card company can put the payment on hold and file a dispute but the contract seems to prevail with a clause that any "verbal" promises are void. Since none of the misrepresentations are in writing. It appears the "salesmen" have played their con to the max. There is a company that promises to broker "timeshare solutions" also known as G&G (Gonzales& Gonzales) but they seem to good to be true. While they now state that they require no upfront fees until recovery there is a stipulation that if they "need" to go to court there is a $1,200.00 cost. Sounds like a setup to me. While there are many posts to beware of timeshare solutions no one states they got burned yet! Also Jose Gonzales does defend and answer the post on TUG ( timeshare user guide). My plan is to fight them using the credit card dispute for misrepresentation ( delay), Timesahre Solutions with nothing paid upfront all costs and fees to come out of money recoverd. and Third refuse to pay any more money for the note and tell them to sue me and take a number.
Does anyone have any other thought ideas or plans to fight this scam and con. There must be many in the same boat we need to all bail together!

I don't know if you have been looking around the internet much but Jeff Robbins at Home Page has some interesting information and may be interested in forming some kind of a members group to bring some accountability to UVC.

The sad thing is that we have enjoyed our stays at the three places we have been to and it could be great deal even for the developer if they weren't so dang greedy.

Jeff is of the opinion, I think, that enough attention from internet social media groups may be getting through, we shall see.

          Take care

Thanks! I reached out to Jef Robbins. Has anyone heard anything negative about XXXXXXXXXXXXXXXx

I know some of you are going to find this hard to believe but there are shills posting here. Yep I can not point the finger on which but because of a few bad apples I am going into all of these posts and removing all links and the names of the sites, It is a plan shame that a few cheap people looking for free plugs have ruined it for others. All I can say is if you saw the companies posted here look at who you are dealing with. Do you want to deal with people that resort this low

Thank you Big Frank. Keeping these thread clean. I have heard from Jeff Robbins. Is he on the level? The advise he has given me seems solid. I am very concerned for my dad who was taken by the sales staff in Puerta Vallarta.

I can not say if he is or not, I know that we get a ton of shills here, I am not saying it was his company that was doing it. I found some IP's that were very similar so that set off the red flag.

Thank you again. I'll be watching this thread. Hopefully I'll have some good news to post. How anyone can sell a 30 year timeshare to a 79 y.o. is hard to believe.

I'm with you here. Totally inappropriate.

I will just note that I've had reason to work with Jeff for reasons unrelated to the issues addressed in this thread. I believe him to be on the level.

                    Safe travels.

Thanks. my Dad has spoken with Jeff Robbins and he is happy with what he had to say and that he can help. He has been very encouraging and hopefully all will turn out OK. A new owner, 79 y.o., multiple misrepresentations and FRAUD by salesmen who only care about making as much money as they can and will say anything to sell timeshares.

I have been involved with timeshares since 1978 in Maui and then in Mexico PV in 1985. Timeshares are great if you use the weeks for personal use. The main problems are booking the week you want so book early, ever increasing maintenance fees ( the cost for a week seems to go up and up, not to mention those special assessments), and trying to rent the weeks out or trying to sell them.
Last summer I spent two weeks in Maui and found that many people (non- owners) rented weeks for the cost of the maintenance or in some cases less than the yearly fees. Never, never, never consider a timeshare for investment purposes or the anticipation that you can make money. The old caveat holds true. "If it sounds too good to be true, IT IS !!!!"

I'm in the same boat. I don't even care about my down payment anymore. Just want to cancel the contract and go on with my life. Has anybody been successful in terminating the contract?

Making some progress! Will keep you updated on cancellation. While all circumstances are unique there seems to be a common thread for misrepresentation.

I asked for written information from them and then asked what kind of assurance was there that the rental would of the extra would would take place. I was told that there is nothing sure in this world, but that they would try their darndest to make sure that I received the $2900 that our unit would earn. I really can't believe that I fell for the upgrade to points, but I did.
Watch out!!! Girard is a con artist!! do not pay any fees for renting out your units. Put a stop on anything you sent to Steve Girard!!

BF is right. The same IP red flags popped up in regards to IP's and new posters 3 or so years in regards to the Bel Air in PV that was never built.
