I have the same story I have read multitudes of other places, here is the basic summary.
Go on vacation in Cabo with my wife in 2007, get lured into attending a timeshare presentation for a free gift. (At that point it was Playa Del Sol Grand)
Spend several hours at the presentation, well practiced con artists whittling away at our resistance until we finally agree to buy a package.
Next morning, with great remorse go back to PDS to cancel. They show us on the contract where we initialed that they would keep our $2,000 in the event of cancellation.
Feeling defeated we walked away with out officially cancelling.
Been paying the monthly payment ever since. (A that point we just figured we were pressured into buying something we didn't want to buy, It wasn't until recently I found out the depth of the scam)
Finally had the money to go on vacation this year, 4 years later we are going to try to use the condo, Finally!
Ended up getting the run around, first, no one speaks English that you can understand. "Oh we are very sorry we can't make reservations for Cabo from this office you need to call another number..I call that number, Oh you are an owner? You need to call owner support office...I call owner support office...I get voice mail....I leave message...no call back....I leave another message no call back....finally after a couple days I receive a call back, but this time it goes to my voice mail...
Frustrated, I send an email to an address I found on the website, I receive a response something to the effect of "Were sorry for your trouble, when would you like to make a reservation?....
Then of course there are no rooms available, unless of course I want to upgrade to the brand new all inclusive resort for only $65 per person per day.. I said no, I really just want the room with the kitchen that I purchased...
Long story short I was so fed up that I didn't go to Mexico...
After researching on the web my understanding is that they scam people into buying, then they do everything they can to make sure you never actually use the condo, instead they rent the rooms as hotel rooms and then scam the new "customers" and the cycle continues...
I have heard of a few, (very few) people successfully getting their money back, usually by engaging lawyers and Profeco immediately while still in Mexico.
Do I have any recourse at this point?
Please let me know if anyone has ideas that may help..
