  • Ocho Cascadas, that very unique and romantic place.....

    It will be open again. I found these two websites here and you may like to read about it. Not that there will be any exchanges to these condos soon but something to dream about.

    http://ochocascadas.com/ and a Facebook page. The added lift and A/C in the master bedroom will make it very comfy all year long. I have to read some more as I just found these websites from the developer.

              Wasn't there an extension of the RTU ? If not, what happened between 2002 and now ?

                Q Why did the original Ocho come to an end?
                A. The Club was originally set up as a 30 year membership, which was the only thing available in Mexico at that time.
                Q. What will be different about the New Ocho?
                A. First, the members of the Club will also be the Owners of the land, not just “right to use members”. Also the property is being enhanced to today’s standards… air conditioned bedrooms, new plumbing, electrical, granite countertops, new kitchen appliances, non-slip tile, upgraded lighting and plantings…… And a grand lobby on the upper level with a beautiful two stage elevator to all floors! There will also be reciprocal exchange with sister resort Club Cascadas in Cabo San Lucas and a strong rental and resale program for owners.

                  When did the original RTU come to an end ? Was there a short extension available after the end of the original RTU ?
                  The sales pitch of a "residual" based on the sale at the end of the new RTU sounds a lot like the Royals, which didn't quite turn out so good for Royal Mayan owners.

                    Yes, there was a short extension but now it is a new contract and the owners will own the land and will have to decide together what to do when the new RTU runs out and that is different from the Royals. We met the wife of the architect when we visited her office locally. The number is on the website where you need to get your information. We went there to pick up the book as they were out of them at the resort. It is a beautiful place in a very beautiful area. We loved the horses coming by and hear their hoofs on the cobble stones. Would love to go back there one day.

                        Just curious how owners can now own the land. The law in Mexico still prohibits foreigners from owning any land within 50 miles of the coast or a border. A change in the law has passed one house, but there is still much opposition to changing the law.

                          It will be held in a trust just like it always has been but there are changes coming that I read the other day. That would be hard to do for several owners together, I guess. I will look for the link again and post it later.

                          PS. Here is the link that I found on Facebook the other day. It was posted by a TS4MS friend. It took me awhile to find it again.

                            I think foreigners have been able to own land thru a trust in Mexico for many years now, but not sure when it started.

                              Yes, we have trusts for our property there. However, trusts would be difficult to structure for timeshares. The Mexican legislature is considering making it possible for foreigners to own costal land directly, but it definitely hasn't happened yet. One house has passed the legislation; the other house has not. If both houses pass it, it then has to pass in each state. When the legislation was proposed, many said there was little chance for it; however, the house that was deemed most difficult to get it through ratified it, so analysists then said it would be easy to get through the other house. That has not proved to be the case, and opposition, according to many analysists, is rising (it seems some people remember losing Texas by allowing foreigners to settle on land close to the border). At any rate, it isn't through both houses yet, and each state still has to vote on it if it passes the legislature.
