  • Help! We got scammed by Real Club in Cancun

    Hi everyone. I'm a newbie and got burned less than 30 days ago by Real Club in Cancun.

    Here is a summary of our plight.

    We checked into the Gran Caribe Real on December 29, 2008. That day we went to guest services to ask a question about activities. The staff person gave us minimal information and then told us that we could get more information on the hotel if we attended a meeting the next day and if we attended, we would get a free beach bag and sarong and we would be helping her get points for her reward system. We thought it was an information session about the hotel so we signed up.

    The next day we reported to our meeting. We were passed from the lady who greeted us to two other ladies. Neither one told us that it was for a timeshare plan. They sat us in the lounge and gave us drinks. Eventually, Federico P. came over and started the spiel. After a few minutes, he asked us if we were told the reason for the meeting. We replied, “No we were not”. He became agitated and frustrated at that point. He calmed down and went on with his spiel that included a summary of how much we paid for our trip. This part of the meeting took place in a restaurant where they again provided us with alcohol and then a tour of the neighboring hotel.

    The tour finished off in the sales room where Federico, Fabio and others used high pressure tactics and more alcohol to try to recruit us. They kept bringing us drinks even though my wife commented that she didn’t need anymore because she has a low tolerance to alcohol. They never left us alone to speak and even sent someone to accompany me to the men’s room.

    The real issue lies in the fact that they lied to us about rates and switched schedules in the contract on us.
    1) Selling the weeks. We were told that we could sell up to 5 weeks per year for $1000 per week or more, it seemed like a good idea. We could use the money to pay for the plan and save for our next trip. When I called yesterday, I was told to call a person at Global Research. I was told by her that we had to pay a fee of $600 up front in order to sell. It was then I started to research and found out all the complaints. There are warnings against Global Research but to do with Secret Shoppers and paying people with phony cheques. The whole thing smelled bad. In light of the troubles we have had so far with Real Club, I’m not taking the chance of paying any more money up front. I've since heard that it's not likely you'll get back what you’ve paid for the week.

    2) When they were giving us the spiel, they routinely stated that the fees you pay when you book your weeks (Exhibit C) were per double occupancy for the week. The sheet they used for the demonstration had no mention otherwise. My wife asked 4 times, "and this cost is per week based on double occupancy?" and they replied, "yes".

    At one point we were talking about using RCI and going to Greece on our weeks. She asked about the fee for that. Fabio replied, "Yes, you can go to Greece for $489 per week."

    When we looked over the contract I didn't see the line in there that said, "ALL INCLUSIVE preferred rates (USD) prices are per person per night”, in Exhibit C. Based on the information they provided, it appeared to be a good deal for us and for our kids in the future. We agreed to take the 400 week package at a cost of $19, 985 USD.

    Once we said yes, they were immediately over there with the champagne and kept if flowing all through the signing of the contract. There was a problem with some of the free items they offered in the negotiation including 3 free trips to Cancun, a cruise and a Transfer to the Royal Hotel next door. They took the contract papers to the office to fix the issues and changed the sheet that included the per person / per night section. The lady we were signing the contract with, Gricelda Vielma held the contracts while we signed and only showed the bottom portion of each sheet. They had gotten us drunk so we didn't catch it when we initialed the contract.

    We called the Real Club yesterday to inquire about selling weeks and to book for next year. It was then that we found out about the switch to per person per night. When we expressed concern about the change, the gentleman, Mr. Marcos Vallado replied, “too bad, you signed the contract”.

    We have done the math using the membership preferred rates and to stay in the same room we booked for our initial trip, we would end up paying more for the whole trip than if we booked again through Signature Vacations. Who would sign such an agreement if they weren’t lied to?

    Now every time I call there, I get put on hold and eventually transferred to a message asking me to leave a voice mail. Also, Mr. Vallado provided my wife with a false e-mail address when she wanted to file a complaint and cancel the agreement. This is not how a respectable enterprise operates.


    If anyone has any input on how to proceed to fight this and cancel the contract..

    C.A.R.E. assists the parties within free of charge mediation/conciliation procedures, based upon the terms of the contract that consumer supplies.

    To start the conciliation/mediation procedure C.A.R.E. must analyze the documentation submitted by the consumer related to the following information:

    1. Complaint letter stating the following:

    Consumer: name, mailing address, telephone number and e-mail.
    Supplier: name and address as stated on the receipt or contract.
    Brief description of the complaint, including the date of purchase, cost of the goods or service, and claimed amounts.
    2. Completed complaint form
    3. Copy of ID (Passport or Driver's License)
    4. Copy of contract, invoice payment, bills, credit slips or receipts, as evidence of payment.
    5. Copy of additional documents available to support the complaint.

      My experience is almost identical. We were sucked in with the vaciation ideas and the fast numbers. Now that we are trying to use a week through RCI the took another $400 just to tell us there is not a timeshare anywhere in the US that meets our needs. Please if you find a way out of the scam share the information. Thanks

        Hi Shirely.

        We are currently using the Mexican Agency Profeco. The link is in the message above by Bill. It's likley your best best.
        What I can tell you is DO NOT USE THE OWNERS ADVOCATE.
        They are rip off artists.

        We paid the $500 up front for the package that they said they would tailor for use with Canadian laws. The package they sent was the standard US one. After we complained strongly, they told us that they rework the forms to reflect Canadian laws. When they sent it again, all they had removed was the references to US law.

        This was within the 10 day cooling off period and so I contacted them, telling thee I was not confident in their promises to deliver and wanted to cancel the contract. After numerous phone calls and many attempts by them to have me continue, I eventually hung up. I tried to reverse the charges to the credit card but that was recently refused. so I am now out another $500. Stay away from these crooks.

          Let me first say that I just found this forum and am so glad that there is a community of people who have also gone through the horror of timeshares like I have! I have a timeshare with Bluegreen that I've been trying to get rid of for over a year now. I tried selling it on one of those scam reseller websites, but of course, just lost more money. I'm not from Canada (I live in Arizona, actually), but I am currently working with The XXXXXXXXX. So far they have been extremely helpful! Michelle is who I've been talking to and she helped me get the collections calls to stop, which in itself is wonderful. I haven't gone through the entire process with them, but so far I would recommend it!

            I was taken by the resort in Mexico and I called the XXXXX and signed up... I'm still waiting to see what they can do for me. Anybody have any luck with this resort and XXXXXX.
            I had a friend refer me and he said they were able to get him out oh his contract with wyndham. I know this is a different deal but I am willing to try anything!

                Has anyone on here ever gotten a release from a mexican timeshare? It is my understanding that they are very difficult to deal with and will not let anyone out of their deals.

                I hope I am not overly optimistic on this

                  I got scammed at Gran Caribe Real Cancun as well

                  Right now I am filing with Profeco and I also filled a complaint on the ripoffreport.com and thesqueakywheel.com Everytime someone logs on to that complaint Gran Caribe Real Cancun gets an e-mail message, it also shows up on search engines for yahoo and google. They have actually now responded to me after 2 years of trying to get a hold of someone. If you have noticed their e-mail addresses on their website no longer work and when you call they just put you on hold and no one ever comes back to talk to you. We were totally lied to and I would do anything to get my money back. If anyone has any other ideas let me know. Thank you.

                    Though I do agree the way in which the real club persuades you to purchase a membership may be a little on the "shady" side but I have a membership and know about 15 others who do as well that love it! I did not spend $20,000 to purchase mine either. I continuously told them no and at the end they offered me a 12 week, $2,000 option that has 5 blackout dates. I have been a member for almost 3 years now and most of the weeks have been used, but I will be "renewing" my membership soon. I have sold a few of my weeks through RCI with no problems as well. The Real Club team has always been very nice and as helpful as possible. In May we went to Playa del Carmen for my college graduation and decided I liked the "scene" of Cancun much more. I simply contacted the represenative at the hotel and asked to be switched to the Gran Caribe in Cancun, within an hour I had received a phone call asking me when I would like to transfer hotels, cost free. Once at the Gran Caribe we decided to upgrade our room, which took about 10 minutes from start to finish.

                      This is not shady, it's outright lying. They quoted us prices in the presentation that they claimed were for the week. We asked 3 times, very clearly, "These are rates for the entire week?" and Fabio responded, "Yes, that rate is for the whole week." Then they slip in the schedule that the rates are daily, after we read the contract. That is outright lying.

                        I too recently purchased this membership in June 09,and just recently booked a 2nd trip for next month online on their realclub.com, signed confirmation for payment and done! No problems! for which we sold on our own! I have yet to run into any issues like I thought I would after reading many post complaining about the treatment. Hopefully you all get your issues resolved. One thing that has not worked like they exclaimed is the 3rd party company we paid to sell our weeks! We paid $300 to the agency in June and have yet to have anything sold and keep getting excuses!! It looks as though we are having better luck selling them on our own.

                            I am not a sales rep of any kind. I visited Gran Caribe Real in Cancun in June 2007 for my honeymoon, and loved the hotel/activities. So this June, my husband and I decided to go back again. And of course we fell into the whole longggg (4.5 hours) sales pitch, and after much thought and consideration we said yes. Only because I come from a large family, who always vacation together, in which all 27 of them also joined us on our first trip (yes our honeymoon) to rent weeks out to and gain some $$ back. After my husband regreted the choice to buy it because of course they made it sound so much better than what it really is. such as selling weeks for $500-1000 (lie) and make our money back (lie), so I did research alot of it about them and this club membership...in which I found ALOT of negative reviews, and little few positives. I at that point felt like my husband was right, thinking we made a mistake. BUT then I booked a trip for my aunt in August and making the reservation was super easy, I just went online and made it. Customer rep contacted me and I signed the payment auth for the all inclusive rates. And just yesterday I booked another trip for my aunt at the Real Playa for super cheap $44/pp (about 50% cheaper than online rates from various vendors) and made $280 profit still. So I am sorry, if you dont believe me, and understand why, since you may have had a bad experience with them. BUT I HAVEN'T, I am and was being 100% honest in my post. I am a Registered Nurse here in CA, and never ever was a sales rep...I suck at sales LOL. Good luck and god bless with your ordeal, and I pray that it all works out.
